Research Review of the Sharia and Legal Scope of Drugs
Abstract
History tells us that addiction has been a problem for man since the beginning because man has always wanted to be intoxicated. He wants to escape from the sorrows and worries of the world. In such a situation, addiction is the only process that solves both of these problems for man. Only Islam has given full emphasis on eliminating drugs from human life and has introduced a general term for it. Drugs are derived from intoxication, for which the word "khamr" is commonly used in the Arabic language. Hazrat Umar Farooq has explained khamr in the following words: It is narrated from Sayyiduna Ibn Umar that Sayyiduna Umar said; I was sitting on the pulpit of the Prophet (ﷺ) and I heard him say: O people! When the prohibition of wine was revealed, it was prepared from five things: grapes, dates, honey, wheat and barley. In view of Islamic teachings and the prohibition of drugs in Islam, the prohibition of drugs is clear in the constitution and laws of Pakistan. Alcohol and its various forms, as well as snuff, pan, gutka, and all other types of drugs are prohibited. Both developed and developing countries have been affected by all these aspects of drugs. Despite thousands of measures, Pakistan has not remained free from addiction to paan, gutka, cigarettes, snuff, and alcohol. Even the institutions of knowledge and consciousness, from which enemies of such evil intentions are born, have not remained free from drugs. On September 16, 2018, the Supreme Court Lahore took notice of the use of drugs in private and government educational institutions, after which a wave of concern spread across the country, including the Senate, but no steps have been taken to prevent it yet.
